SABAH CITIZENS DEMAND  TRANSPARENCY AND ACTION ON MA63 AGREEMENT ...


We, the deeply concerned citizens of Sabah, vehemently reject the recent statement by Chief Minister Datuk Seri Hajiji Noor dismissing the need for a Sabah State Assembly special sitting on the Malaysia Agreement 1963 (MA63). 

The MA63 agreement is not a private government concern; it's a fundamental document impacting the lives and futures of all Sabahans. Since 1963, we have waited in vain for official public discourse and participation in this critical issue.

MA63, which created Malaysia, was from the beginning secretly determined by the UK and Malaya to preserve British interests in Asia by incorporating Sabah and Sarawak into the Malayan Federation. It has been an idea that benefited Malaya to the detriment of the 2 Borneo countries.

To achieve their plan, they denied the people of North Borneo and Sarawak their right to freely express their views in a referendum on whether they wanted their country to federate with Malaya and Singapore or not and choose independence. 

Since that time, the governments of Sabah and Sarawak have been directly controlled by Malaya, and the people were intimidated from speaking with the threat of the ISA and imprisonment. Datuk Dr Jeffrey Kitingan and six other Sabahans were detained for questioning MA63 lost rights.

The Chief Minister must be reminded that he serves at the behest of the Sabah people, not his own personal or political interests. The promises and assurances enshrined in the MA63 – security, social, and economic prosperity (assuming its validity) – demand thorough debate in the state assembly. The glaring absence of these promised benefits suggests a non-compliance and blatant breach of the agreement.

A prime example of this broken promise and breach on security is the presence of illegal immigrants who have been inexplicably issued documents, registered to vote, and allowed to participate in elections. This unacceptable situation demands immediate solutions.

Sabah citizens deserve clear and unequivocal answers. We demand the Chief Minister address the following:

* Why is a special assembly sitting not deemed necessary to discuss an issue of such paramount importance to Sabah?
* Does the Chief Minister have the full backing of the state assembly in his position on the MA63 agreement? If so, how was this consensus reached? 
* What concrete steps will be taken to ensure Sabah receives the security and economic benefits promised in the MA63 agreement?
* If MA63 was a valid international treaty, then would not the multiple breaches of fundamental conditions render the treaty null and void and no longer binding. 

Furthermore, the opaque handover of Sabah's oil and gas resources to Petronas, bypassing any debate, state assembly approval, or consent from the governed, has left us financially hamstrung and unable to fund essential services, thereby exacerbating poverty. 

The lack of transparency surrounding the MA63 agreement breeds uncertainty and confusion among Sabah citizens. 

The MA63 revenue entitlement is a good example of how we have secret governance instead of open and transparent governance. 

It has taken 50 years for the issue to come to light, and even so, the Sabah government acted improperly to oppose the Sabah Law Society's 40% review in the Court of Appeal. 

We demand a full and frank explanation from the Chief Minister. The future of Sabah hinges on a fair and just resolution to this long-standing issue.  It is now time to allow all the people to freely express their views on MA63 and Malaysia.

**Rakyat Sabah Menuntut Ketelusan dan Tindakan Mengenai Perjanjian MA63**

Kami, rakyat Sabah yang sangat prihatin, dengan tegas menolak kenyataan terbaru oleh Ketua Menteri Datuk Seri Hajiji Noor yang menolak keperluan untuk mengadakan sidang khas Dewan Undangan Negeri Sabah mengenai Perjanjian Malaysia 1963 (MA63).

Perjanjian MA63 bukanlah isu peribadi kerajaan; ia adalah dokumen asas yang mempengaruhi kehidupan dan masa depan semua rakyat Sabah. Sejak tahun 1963, kami menunggu dengan sia-sia untuk diskusi dan partisipasi awam rasmi mengenai isu penting ini.

MA63, yang membentuk Malaysia, sejak awal ditentukan secara rahsia oleh UK dan Malaya untuk memelihara kepentingan British di Asia dengan menggabungkan Sabah dan Sarawak ke dalam Persekutuan Malaya. Ia adalah satu idea yang menguntungkan Malaya tetapi merugikan dua negara Borneo.

Untuk mencapai rancangan mereka, mereka menafikan rakyat Borneo Utara dan Sarawak hak mereka untuk menyatakan pandangan mereka secara bebas dalam satu referendum tentang sama ada mereka mahu negara mereka bergabung dengan Malaya dan Singapura atau tidak dan memilih kemerdekaan.

Sejak itu, kerajaan Sabah dan Sarawak telah dikendalikan secara langsung oleh Malaya, dan rakyat diancam untuk bersuara dengan ancaman ISA dan penjara. Datuk Dr. Jeffrey Kitingan dan enam orang Sabah yang lain telah ditahan kerana mempertikaikan hak-hak MA63 yang hilang.

Ketua Menteri mesti diingatkan bahawa dia berkhidmat atas kehendak rakyat Sabah, bukan untuk kepentingan peribadi atau politiknya. Janji-janji dan jaminan yang terkandung dalam MA63 – keselamatan, kemakmuran sosial dan ekonomi (dengan menganggap kesahihannya) – menuntut perdebatan yang menyeluruh dalam dewan undangan negeri. Ketidakhadiran yang ketara daripada manfaat yang dijanjikan ini menunjukkan ketidakpatuhan dan pelanggaran terang-terangan terhadap perjanjian tersebut.

Contoh utama janji yang dilanggar dan pelanggaran keselamatan adalah kehadiran pendatang tanpa izin yang telah diberi dokumen secara tidak dapat dijelaskan, didaftarkan untuk mengundi, dan dibenarkan untuk menyertai pilihan raya. Situasi yang tidak boleh diterima ini memerlukan penyelesaian segera.

Rakyat Sabah berhak mendapatkan jawapan yang jelas dan tegas. Kami menuntut Ketua Menteri menjawab soalan-soalan berikut:

* Mengapa sidang khas dewan tidak dianggap perlu untuk membincangkan isu yang begitu penting bagi Sabah?
* Adakah Ketua Menteri mendapat sokongan penuh dewan undangan negeri dalam pendiriannya mengenai perjanjian MA63? Jika ya, bagaimana konsensus ini dicapai?
* Apakah langkah-langkah konkrit yang akan diambil untuk memastikan Sabah menerima manfaat keselamatan dan ekonomi yang dijanjikan dalam perjanjian MA63?
* Jika MA63 adalah perjanjian antarabangsa yang sah, tidakkah pelanggaran asas yang berulang-ulang akan membatalkan perjanjian itu dan tidak lagi mengikat?

Selain itu, penyerahan sumber minyak dan gas Sabah kepada Petronas secara tidak telus, tanpa melalui sebarang perdebatan, kelulusan dewan undangan negeri, atau persetujuan rakyat, telah meninggalkan kami dalam keadaan kewangan yang teruk dan tidak mampu membiayai perkhidmatan asas, dengan itu memperburuk kemiskinan.

Kekurangan ketelusan mengenai perjanjian MA63 menimbulkan ketidakpastian dan kekeliruan dalam kalangan rakyat Sabah.

Hak kelayakan hasil MA63 adalah contoh yang baik bagaimana kita mempunyai pentadbiran rahsia daripada pentadbiran terbuka dan telus.

Ia telah mengambil masa 50 tahun untuk isu ini menjadi perhatian, dan walaupun begitu, kerajaan Sabah bertindak tidak betul dengan menentang kajian 40% oleh Sabah Law Society di Mahkamah Rayuan.

Kami menuntut penjelasan penuh dan jujur daripada Ketua Menteri. Masa depan Sabah bergantung pada penyelesaian yang adil dan saksama terhadap isu lama ini. Kini tiba masanya untuk membenarkan semua rakyat untuk menyatakan pandangan mereka secara bebas mengenai MA63 dan Malaysia.

Federal needs to explain why Sabah MM2H disrupted

Dear Ministry of Tourism, Arts and Culture (Motac),

We are writing to express our deep concern regarding the recent suspension of the Sabah-Malaysia My Second Home (MM2H) programme by Motac. The Sabah MM2H program promised significant economic benefits to the state, and its abrupt suspension has caused disappointment and confusion among potential applicants and Sabah residents.

We understand that the Sabah State Government, through the Ministry of Tourism, Culture and Environment (KePKAS), had completed all necessary preparations for a June 1st launch. Motac's decision to halt operations for all licensed MM2H agents, including those in Sabah with valid Motac licenses, has disrupted these plans and created uncertainty.

We urge Motac to provide a clear and public explanation regarding the following:

* The legal basis for suspending the Sabah-MM2H program, especially considering valid licenses held by Sabah agents.
* The rationale behind this decision, particularly in light of the program's potential to attract foreign investment and boost Sabah's economy.
* In the interest of transparency, we request Motac to clarify its specific role and authority in the policy making process for the MM2H program, particularly concerning Sabah's right to develop its own program.

We believe a collaborative approach between Motac and the Sabah state government is crucial to ensure a successful MM2H program that benefits all parties and put the matter in the Joint List or Concurrent List. Sabah has the right to establish its own MM2H policy, and we urge Motac to respect this autonomy.

We appreciate your prompt attention to this urgent matter and look forward to a swift resolution.

Kepada Kementerian Pelancongan, Seni dan Budaya (Motac),

Kami menulis untuk menyuarakan keprihatinan mendalam kami mengenai penggantungan baru-baru ini program Sabah-Malaysia My Second Home (MM2H) oleh Motac. Program Sabah MM2H menjanjikan manfaat ekonomi yang besar kepada negeri ini, dan penggantungannya secara tiba-tiba telah menyebabkan kekecewaan dan kekeliruan di kalangan pemohon berpotensi dan penduduk Sabah.

Kami memahami bahawa Kerajaan Negeri Sabah, melalui Kementerian Pelancongan, Kebudayaan dan Alam Sekitar (KePKAS), telah menyelesaikan semua persiapan yang diperlukan untuk pelancaran pada 1 Jun. Keputusan Motac untuk menghentikan operasi semua ejen MM2H berlesen, termasuk yang di Sabah dengan lesen Motac yang sah, telah mengganggu rancangan ini dan mencetuskan ketidakpastian.

Kami mendesak Motac untuk memberikan penjelasan yang jelas dan terbuka mengenai perkara-perkara berikut:

* Asas undang-undang untuk menggantung program Sabah-MM2H, terutamanya memandangkan lesen sah yang dipegang oleh ejen Sabah.
* Rasional di sebalik keputusan ini, terutamanya memandangkan potensi program ini untuk menarik pelaburan asing dan meningkatkan ekonomi Sabah.
* Demi ketelusan, kami meminta Motac untuk menjelaskan peranan dan autoriti spesifiknya dalam proses pembuatan dasar untuk program MM2H, terutamanya mengenai hak Sabah untuk membangunkan programnya sendiri.

Kami percaya pendekatan kolaboratif antara Motac dan kerajaan negeri Sabah adalah penting untuk memastikan program MM2H yang berjaya yang memberi manfaat kepada semua pihak dan patut di masuk dalam Joint List stau concurrent List. Sabah mempunyai hak untuk menubuhkan dasar MM2H sendiri, dan kami mendesak Motac untuk menghormati autonomi ini.

Kami menghargai perhatian segera anda terhadap perkara mendesak ini dan berharap penyelesaian yang cepat.

*MASYARAKAT BAJAU LAUT ATAU PALAUH PERLU DILINDUNGI, BUKAN DIBAKAR RUMAH & BOT MEREKA*


1. Laporan dan gambar/video agensi penguatkuasaan kerajaan mengusir masyarakat Palauh atau Bajau Laut di Semporna dengan cara meroboh dan membakar rumah serta bot mereka amatlah tidak bertamadun, sangat kejam, tidak berperikemanusiaan dan kurang pertimbangan.
2. Komuniti Palauh yang hidup dan menetap di laut di atas bot atau rumah-rumah tradisional mereka di atas atau pinggir laut adalah antara kumpulan paling rentan (vulnerable) dan terdedah kepada sebarang ancaman.
3. Gaya hidup unik masyarakat ini di atas laut sudah wujud sejak sebelum pemerintahan moden wujud, dan kumpulan mereka bukanlah ramai sangat. Mereka memiliki kehidupan ringkas dan mungkin hampir semua  tidak memiliki dokumen diri.
4. Saya berpendapat, dan ramai sependapat, jikapun mereka telah memasuki kawasan Taman Sabah di lautan Semporna dan gagal mematuhi notis lari meninggalkan 'kawasan' itu, tapi kakitangan kerajaan diarah meroboh dan membakar rumah serta bot-bot Palauh ini adalah tidak berperlembagaan dan tidak boleh dipromosikan sebagai kaedah SOP kerajaan bertamadun.
5. Gambar-gambar penguatkuasa ini hanya menggunakan tenaga tangan mereka untuk meroboh rumah komuniti ini membuktikan masyarakat ini perlu dilindungi dan dituntun kepada kehidupan yang lebih baik dan tertib, mungkin boleh dipertimbang penempatan khas mereka di kawasan sekitar Semporna.
6. Ke mana mereka hendak lari bawa anak isteri mereka? Sedangkan ikan jerung, buaya, anjing, kucing diberikan laluan merayau dalam banyak kawasan larangan dan mengganggu, inikan pula manusia / insan yang boleh dididik dan dibimbing dilayan begini buruk.
7. Tiba masanya kerajaan lebih pro-aktif mencari penyelesaian yang lebih baik kepada semua yang duduk sudah berkurun di bumi Sabah ini tak kira bangsa, bukannya mengambil tindakan sebegini yang merosak imej negara Malaysia dan Sabah.
8. Kenapa memperguna sesetengah komuniti ketika mempromosi pelancongan dan keunikan Sabah tapi membakar rumah mereka bila mereka mahu dikorbankan untuk tujuan lain sesetengah pihak?

KOTA KINABALU : Dr Julia Emelda Ongkili telah dilantik pemangku pengerusi Majlis Kerja Negeri Sabah, Parti Sedar Rakyat, mulai 28 Mei, 2024.

Ia berikutan cuti rehat dan rawatan Prof Dr Ariffin Willie Muhamad selama tiga bulan.

Setiausaha MKN Sabah, Husain Mohamad, dalam satu kenyataan berkata, Dr Julia akan mengetuai Sedar Sabah sepanjang pengerusi bercuti rehat.

Dr Julia adalah timbalan pengerusi MKN Sabah parti blok Borneo itu, di samping turut mengetuai Sedar di DUN Tamparuli. Beliau adalah anak mendiang timbalan ketua menteri zaman Berjaya, Datuk Dr James Ongkili.

Ketika dihubungi Borneo Herald, Dr Julia berkata beliau akan memikul amanah pengerusi sebaik mungkin termasuk meneruskan program yang sudah dirancang untuk tiga bulan ini.

"Terima kasih atas kepercayaan ini serta sokongan padu dari pimpinan MKN, kita akan terus bekerja tiga bulan ini, dan kita tidak membuang masa," kata Dr Julia yang juga ketua KDMR parti itu.

Beliau yang sangat aktif melayani masyarakat juga adalah pemimpin pelbagai NGO termasuk Kelab Rotary dan sayap wanita KDCA, dan telah berkampung di Lamin Tuaran di pekarangan KDCA sepanjang Tadau Kaamatan yang baru selesai beberapa hari lepas.#

ITEMISED THE RM 12.9 and 16 BILLION FEDERAL ALLOCATION TO SABAH - 2023 and 2024.


The PMX Anwar Ibrahim assertion that the RM16 billion allocated to Sabah, maybe more than the 40% revenue the state is seeking, refers.

The RM16b and 40% are separate issues.

The Sabah government does not control the RM16b.

The Sabah government would control the 40%.

The federal government must urgently provide full transparency regarding the RM 12.9 billion and RM 16 billion allocated to Sabah for the years 2023 and 2024, respectively. It is imperative that the purpose and figures of these allocations be itemized for public scrutiny. The amounts entering, if any, into the state coffers must also be clearly stated. There is a pattern where the federal government announces substantial allocations for Sabah, but upon closer inspection, these funds mysteriously fail to materialize.

Dear Prime Minister,

The concerned citizens of Sabah request comprehensive details regarding the federal allocations mentioned. Transparency in the allocation and utilization of these funds is crucial for maintaining public trust and ensuring accountability. Please provide answers to the following questions to address the concerns of Sabahans:

1. could you provide an itemized breakdown of the RM 12.9 billion allocated for 2023 and the RM 16 billion allocated for 2024? Please include the specific projects, their purposes, and the respective amounts allocated to each.

2. For each project funded by these allocations, could you specify the geographic location (district, town, or village) and the commencement and expected completion dates?

3. How much of the allocated funds have actually been received by the state coffers of Sabah for both years, if any? Please provide documentation or proof of these transactions.

4. For each project, could you provide detailed implementation plans, including the total cost, scope of work, contractors involved, and progress updates?

5. What mechanisms are in place to ensure that the allocated funds are used effectively and reach their intended purposes? How can citizens and independent bodies verify and monitor these expenditures?

6. What reporting structures and accountability measures are in place to track the progress and financial integrity of these projects? Will regular updates be made available to the public?

We believe that answering these questions will significantly enhance transparency and ensure that the allocated funds are utilized for the benefit of Sabahans. Your prompt and detailed response to these inquiries will be greatly appreciated by the people of Sabah.

Adalah penting tujuan dan angka peruntukan ini diperincikan untuk pengawasan awam. Jumlah yang memasuki, jika ada, ke dalam perbendaharaan negeri juga mesti dinyatakan dengan jelas. Terdapat corak di mana kerajaan persekutuan mengumumkan peruntukan besar untuk Sabah, tetapi apabila diteliti, dana ini secara misteri gagal sampai ke Sabah.


Perdana Menteri yang dihormati,

Rakyat Sabah yang prihatin memohon butiran lengkap mengenai peruntukan persekutuan yang disebutkan. Ketelusan dalam pengagihan dan penggunaan dana ini adalah penting untuk mengekalkan kepercayaan awam dan memastikan akauntabiliti. Sila berikan jawapan kepada soalan berikut untuk menangani kebimbangan rakyat Sabah:

1. Bolehkah YAB menyediakan perincian RM 12.9 bilion yang diperuntukkan untuk tahun 2023 dan RM 16 bilion yang diperuntukkan untuk tahun 2024? Sila sertakan projek tertentu, tujuannya, dan jumlah yang diperuntukkan kepada setiap satu.

2. Bagi setiap projek yang dibiayai oleh peruntukan ini, bolehkah YAB nyatakan lokasi geografi (daerah, bandar, atau kampung) dan tarikh mula serta tarikh jangkaan siap?

3. Berapa banyak daripada peruntukan yang telah diterima oleh perbendaharaan negeri Sabah untuk kedua-dua tahun tersebut, jika ada? Sila berikan dokumentasi atau bukti transaksi ini.

4. Bagi setiap projek, bolehkah YAB menyediakan rancangan pelaksanaan terperinci, termasuk kos keseluruhan, skop kerja, kontraktor yang terlibat, dan kemas kini kemajuan?

5. Apakah mekanisme yang ada untuk memastikan bahawa dana yang diperuntukkan digunakan dengan berkesan dan mencapai tujuan yang dimaksudkan? Bagaimana warga dan badan bebas boleh mengesahkan dan memantau perbelanjaan ini?

6. Apakah struktur pelaporan dan langkah-langkah akauntabiliti yang ada untuk mengesan kemajuan dan integriti kewangan projek-projek ini? Adakah kemas kini berkala akan disediakan kepada umum?

Kami percaya bahawa menjawab soalan-soalan ini akan meningkatkan ketelusan dengan ketara dan memastikan bahawa dana yang diperuntukkan digunakan untuk manfaat rakyat Sabah. Tindakan pantas dan jawapan terperinci YAB kepada pertanyaan ini akan sangat dihargai oleh rakyat Sabah.

GRS State Government fails in transparency and accountibility on the 40% case, claim NGO leaders

JOINT PRESS STATEMENT SABAH’S 40% REVENUE ENTITLEMENT:

SABAH Sarawak NGOs leaders, Messrs Daniel John Jambun President of Borneo's Plight in Malaysia Foundation (Bopimafo), Robert Pei President of and Sabah Sarawak Rights Australia New Zealand (SSRANZ) & Voon Lee Shan President of the Parti Bumi Kenyalang Party and other NGOs said in a joint Press Statement today, that the Sabah GRS Government has not shown transparency and accountability in failing to explain why it opposed the Sabah Law Society’s High Court application to review the 40% revenue entitlement.

The initial opposition by the government to the SLS application, followed by the controversial remarks made by a government-appointed lawyer had ignited widespread public outrage and condemnation. 

On 16 May 2024, the lawyer who unexpectedly appeared in the Court of Appeal's case mention session claiming to represent the Government had informed the court that the GRS government opposed the application on grounds that SLS did not have locus standi and that the claim for the MA63 agreed 40% entitlement to Sabah revenue was "merely an aspiration". 

In response to the public outrage and angry backlash, the GRS government went into damage control retracted its submission to the Court of Appeal and dismissed the lawyer who caused the uproar. It further disassociated itself from his damaging remarks.

The subsequent retraction of the opposition by the government indicates the power of public pressure and the importance of accountability in governance. However, the failure to provide a proper explanation as to why it had changed its original stand to support the SLS application only increased public criticism that there was a serious breach of public trust by the government which was supposed to defend Sabah's rights. 

It appears from comments by some leaders of other coalition government member parties, that they were not even made aware of the submissions to be made as the government had originally supported the application. 

The NGOs said this incident must put Sabahans on alert and always be vigilant in scrutinising all actions of their government and ensure that it acted in utmost good faith to represent their interests in a transparent and accountable manner. It is a clear sign that Sabahans will no longer take things lying down and let politician play with their future.

They said that the issue of the federal government's failure to pay Sabah’s 40% revenue entitlement is one of the continuing multiple fundamental breaches of the Malaysia Agreement 1963 (MA63). If it was a validly made treaty, the breaches would have terminated and rendered it no longer binding on the signatory parties.

This entitlement was one of the foundational terms and conditions for federation which the British and Malayan governments agreed to in convincing Sabah and Sarawak British nominated leaders to accept federation with Malaya and Singapore. The payment should therefore have been made annually without further negotiations.

However, the Malaysian government has since 1963 treated MA63 as not a valid and binding international treaty and the founding document for the formation of Malaysia with its multiple violations and non-implementation of the agreed terms.
This reflected Malayan negotiators’ fore-knowledge that North Borneo (Sabah), Sarawak and Singapore were not independent states with the legal capacity to make binding treaties. The issue was raised by the British government with the then Malayan government. In the first draft of the MA63 treaty (attached), only Brunei one of the intended members of the proposed federation was included as a signatory with Malaya and the United Kingdom. 

It was only after Mr. Lee Kuan Yew pointed out to the British government that the 3 colonies were not signatories to the treaty that they were included for “presentational purposes”. The treaty was signed on 9 July 1963 by British-nominated local leaders and the respective British colonial Attorney-Generals for Sabah and Sarawak.

The 1957 Malayan Federal Constitution amended in 1963 to admit three new members did not even mention MA63 as the founding document for Malaysia until amended in 2021 following the Sabah and Sarawak governments’ demands.

The NGOs said MA63 validity was specifically challenged in a Borneo High Court application in 2018 but this was typically dismissed without proceeding to hear the merits of the case on the ground that the applicants had no locus standi. 

The NGO group therefore calls on the Sabah and Sarawak governments to seek a review of MA63 validity before proceeding any further with their proposed restoration of lost rights. Only by settling this issue can Sabah and Sarawak’s position in Malaysia be clear.

They said the previous Sabah governments’ failure to defend Sabah MA63 rights had led to the imposition of Malayanisation replacing Borneonisation and loss of entrenched rights under ACT354, loss of control of Sabah oil and gas other natural resources under the Continental Shelf Act 1966 Petroleum Development Act 1976 and Territorial Seas Act 2012 and land unlawfully taken by the Federal government. 

They added that the Federal government had acknowledged its flagrant breaches of the treaty by agreeing to implement the terms and conditions but had not shown seriousness in promptly doing the right things to make good its violations. The only way to begin restoring MA63 rights is to abolish all the mentioned legislation affecting those rights after a proper review of MA63 validity

The NGOs asked if the same recalcitrant attitude would be repeated when the High Court in Kota Kinabalu hears SABAR's originating summons on the Territorial Sea Act filed in September last year.

The NGO groups said to continue ignoring these issues is to continue 60 years of violation of the people's trust that the paramount interest of Sabah must be served first and to inflame “secessionist” feelings.

**KENYATAAN MEDIA BERSAMA HAK 40% HASIL SABAH: 26 Mei 2024**

Tuan-tuan Daniel John Jambun, Presiden NGO Sabah Sarawak Borneo Plight in Malaysia Foundation (BoPiMaFo), Robert Pei, Presiden Sabah Sarawak Rights Australia New Zealand (SSRANZ) & Voon Lee Shan, Presiden Parti Bumi Kenyalang dan NGO lain berkata dalam satu Kenyataan Media Bersama hari ini bahawa Kerajaan GRS Sabah tidak menunjukkan ketelusan dan akauntabiliti dalam gagal menjelaskan mengapa ia menentang permohonan Mahkamah Tinggi Persatuan Undang-Undang Sabah untuk menyemak hak 40% hasil Sabah.

Penentangan awal oleh kerajaan terhadap permohonan SLS, diikuti dengan kenyataan kontroversial yang dibuat oleh seorang peguam yang dilantik oleh kerajaan, telah mencetuskan kemarahan dan kecaman awam yang meluas.

Pada 16 Mei 2024, peguam yang tiba-tiba hadir dalam sesi sebutan kes Mahkamah Rayuan mendakwa mewakili Kerajaan telah memaklumkan kepada mahkamah bahawa kerajaan GRS menentang permohonan itu atas alasan bahawa SLS tidak mempunyai locus standi dan bahawa tuntutan untuk hak 40% yang dipersetujui dalam MA63 kepada hasil Sabah adalah "hanya aspirasi".

Sebagai tindak balas kepada kemarahan dan reaksi keras awam, kerajaan GRS bertindak untuk mengawal kerosakan dengan menarik balik kenyataannya kepada Mahkamah Rayuan dan memecat peguam yang menyebabkan kekecohan tersebut. Kerajaan juga menjauhkan diri daripada kenyataannya yang merosakkan.

Penarikan semula penentangan oleh kerajaan menunjukkan kuasa tekanan awam dan kepentingan akauntabiliti dalam pemerintahan. Walau bagaimanapun, kegagalan untuk memberikan penjelasan yang sewajarnya mengenai mengapa ia mengubah pendiriannya untuk menyokong permohonan SLS hanya meningkatkan kritikan awam bahawa terdapat pelanggaran kepercayaan awam yang serius oleh kerajaan yang sepatutnya mempertahankan hak Sabah.

Nampaknya daripada komen beberapa pemimpin parti kerajaan gabungan lain, mereka tidak diberitahu mengenai penyerahan yang akan dibuat kerana kerajaan pada asalnya menyokong permohonan tersebut.

NGO tersebut berkata bahawa insiden ini mesti membuatkan rakyat Sabah sentiasa berjaga-jaga dan berwaspada dalam meneliti semua tindakan kerajaan mereka dan memastikan ia bertindak dengan niat baik sepenuhnya untuk mewakili kepentingan mereka secara telus dan bertanggungjawab. Ini adalah tanda jelas bahawa rakyat Sabah tidak akan lagi berdiam diri dan membiarkan ahli politik bermain dengan masa depan mereka.

Mereka berkata bahawa isu kegagalan kerajaan persekutuan untuk membayar hak 40% hasil Sabah adalah salah satu pelanggaran asas berterusan Perjanjian Malaysia 1963 (MA63). Jika ia adalah perjanjian yang sah, pelanggaran ini akan membatalkan dan menyebabkan ia tidak lagi mengikat pihak-pihak yang menandatangani.

Hak ini adalah salah satu terma dan syarat asas untuk persekutuan yang dipersetujui oleh kerajaan British dan Malaya dalam meyakinkan pemimpin yang dilantik British di Sabah dan Sarawak untuk menerima persekutuan dengan Malaya dan Singapura. Pembayaran itu sepatutnya dibuat setiap tahun tanpa rundingan lanjut.

Walau bagaimanapun, kerajaan Malaysia sejak 1963 menganggap MA63 bukan sebagai perjanjian antarabangsa yang sah dan mengikat serta dokumen asas bagi pembentukan Malaysia dengan pelanggaran dan ketidaklaksanaan terma yang dipersetujui. Ini mencerminkan pengetahuan awal perunding Malaya bahawa Borneo Utara (Sabah), Sarawak dan Singapura bukanlah negara merdeka yang mempunyai kapasiti undang-undang untuk membuat perjanjian yang mengikat. Isu ini dibangkitkan oleh kerajaan British dengan kerajaan Malaya pada masa itu. Dalam draf pertama perjanjian MA63 (dilampirkan), hanya Brunei salah satu anggota yang dicadangkan untuk persekutuan termasuk sebagai penandatangan bersama Malaya dan United Kingdom.

Hanya selepas Encik Lee Kuan Yew menunjukkan kepada kerajaan British bahawa 3 koloni tidak menjadi penandatangan kepada perjanjian itu mereka dimasukkan untuk "tujuan persembahan". Perjanjian itu ditandatangani pada 9 Julai 1963 oleh pemimpin tempatan yang dilantik British dan Peguam Negara kolonial British yang berkenaan bagi Sabah dan Sarawak.

Perlembagaan Persekutuan Malaya 1957 yang dipinda pada 1963 untuk menerima tiga anggota baharu tidak menyebut MA63 sebagai dokumen asas untuk Malaysia sehingga dipinda pada 2021 berikutan tuntutan kerajaan Sabah dan Sarawak.

NGO berkata kesahan MA63 telah dicabar secara khusus dalam permohonan Mahkamah Tinggi Borneo pada 2018 tetapi ini biasanya ditolak tanpa meneruskan untuk mendengar merit kes atas alasan bahawa pemohon tidak mempunyai locus standi.

Kumpulan NGO tersebut oleh itu menggesa kerajaan Sabah dan Sarawak untuk meminta semakan kesahan MA63 sebelum meneruskan lagi dengan cadangan pemulihan hak yang hilang. Hanya dengan menyelesaikan isu ini kedudukan Sabah dan Sarawak dalam Malaysia dapat dijelaskan.

Mereka berkata kegagalan kerajaan Sabah terdahulu untuk mempertahankan hak MA63 Sabah telah membawa kepada pengenaan Malayanisasi menggantikan Borneonisasi dan kehilangan hak yang terkandung di bawah ACT354, kehilangan kawalan ke atas minyak dan gas Sabah dan sumber semula jadi lain di bawah Akta Pelantar Benua 1966, Akta Pembangunan Petroleum 1976 dan Akta Laut Wilayah 2012 serta tanah yang diambil secara tidak sah oleh kerajaan Persekutuan.

Mereka menambah bahawa kerajaan Persekutuan telah mengakui pelanggaran terang-terangan terhadap perjanjian tersebut dengan bersetuju untuk melaksanakan terma dan syarat tetapi tidak menunjukkan keseriusan dalam melakukannya dengan segera. Satu-satunya cara untuk mula memulihkan hak MA63 adalah dengan memansuhkan semua undang-undang yang disebutkan yang mempengaruhi hak-hak tersebut selepas semakan semula kesahan MA63.

NGO bertanya sama ada sikap keras kepala yang sama akan diulang apabila Mahkamah Tinggi di Kota Kinabalu mendengar saman pemula SABAR mengenai Akta Laut Wilayah yang difailkan pada September tahun lepas.

Kumpulan NGO tersebut berkata untuk terus mengabaikan isu-isu ini adalah untuk meneruskan 60 tahun pelanggaran kepercayaan rakyat bahawa kepentingan utama Sabah mesti didahulukan dan untuk menyemarakkan perasaan “pemisah”.

An open letter to Anwar Ibrahim from PBK's Yu Chin Liik

The Honourable Dato’ Seri Anwar Ibrahim, 

Greetings!

On the occasion of the 25th anniversary of the founding of the Parti Keadilan Rakyat, I congratulate you and all-party members on this auspicious occasion!

Since the inception of the Reformasi movement, I have been supporting your goals of reformasi.  I actively participated in the establishment of the PKR branch in the Bintulu area, and my home had hosted several PKR meetings in Bintulu.

I, Yu Chin Liik, of Sibu, Sarawak, and from the perspective of a 77-year-old elder Sarawakian who had witnessed the history of Malaysia's formation, would like to humbly offer some suggestions for your consideration:

A) Cherish the Malaysia Agreement 1963 

MA63 as an international treaty held up as the supreme document creating Malaysia and ensure that the people of Sabah and Sarawak are not kept perpetually underprivileged or victimised by loss of MA63 rights.

For the last 10 years, the validity of MA63 has been questioned and challenged on various grounds and also questions on whether the Borneo people have benefited from the federation. 

Just as it is illegal for minors to enter into marriage or civil contracts, similarly, agreements made between colonial territories that have not attained independence and sovereign independent States are essentially illegal and void. This is the international law treaty-making principle which states that colonies are not sovereign State with legal capacity to make international treaties. It was affirmed by the International Court of Justice in the Chagos Islands Case in 2019.

Therefore, the MA63 is an extremely fragile agreement, and the beneficiary states of the MA63, especially Malaya as co-originator of MA63 with the United Kingdom, must take special care to ensure that the people of Sabah and Sarawak are not disadvantaged and that they would receive ample benefits, thus cherishing the status of being part of Malaysia. 


According to Malaysia’s first PM Tunku Abdul Rahman, one of the main objectives for transferring Sabah and Sarawak to the proposed Malaysia federation was to develop these 2 former British colonies.
                                               
However, over the past half-century, there have been too many instances of the previous administrations disregarding or even depriving the rights of Sabah and Sarawak, as evidenced by the statement made by Prime Minister, Tunku Abdul Rahman, on July 18, 1963, that if in the future it was found that the formation of Malaysia "did not benefit the 2 territories, they could leave." There are so many instances of "not benefiting" which are regrettable and saddening. That is why there is a surging sentiment amongst the Borneo people that they no longer want Sabah and Sarawak in Malaysia. 

Therefore, the people of Sarawak were encouraged to hear your words on the eve of the 2022 general elections: "If I am elected and become Prime Minister, there will be no need for extensive negotiations; all rights of Sabah and Sarawak will be respected and fully restored." 

Even today, we continue to hold great expectations for the situation to change. The federal and Borneo state governments have acknowledged that there has been 60 years of multiple breaches of MA63 and began negotiations from 2015 to rectify the breaches. 

I understand that to fully restore MA63 rights, the unconstitutional amendments such as ACT 354 (which removed all MA63 rights), the Continental Shelf Act 1966, Territorial Seas Act 2012, the Petroleum Development act 1974 (where they affect our rights) must be repealed.  If this is not done MA63 remains in breach and effectively terminated and not binding on the signatory parties.

B) The distribution of parliamentary seats disproportionately disadvantages Sabah and Sarawak. 

It is imperative to restore their representation to at least the MA63 entrenched level of 34.6% of seats each to Sabah and Sarawak. This was specifically entrenched by Articles 161E and 46 as a safeguard in the Federal Constitution and cannot be altered or removed. 

This seat allocation was intended to safeguard the 3 new federation members rights by allowing them to veto or block any Malayan attempt to pass laws affecting their rights. We note that this seat allocation was a basic/foundational term of Malaysia which the IGC Chairman Lord Lansdowne stated in the British Parliamentary debates on the Malaysia Bill in July 1963, was the “decisive factor” which convinced Borneo leaders to accept federation with Malaya and Singapore. 

The original Singapore seats were given to Malayan parties after Singapore exited for independence in 1965. Article 161E was then removed by amendment of the Constitution in 1976 by ACT 354. If a foundational term is removed, the treaty is destroyed and terminated under international law and the Basic Structure Doctrine upheld by Malaysian law. MA63 would cease to be binding on the signatory parties.

In accordance with the spirit of equal partnership under the MA63, the allocation of parliamentary seats should ideally be one-third each for Sabah, Sarawak, and the Malay Peninsula, as the number of seats symbolises equality.
                                                         
During the 1964 Federal Elections, based on the annexes to the MA63 agreement, the Malay Peninsula was not to exceed two-thirds of the seats, yet it held 104 out of 159 seats (65.4%).

In 1974, during the redistribution of constituencies for the Federal Elections, the Malay Peninsula's representation in the Lower House of Parliament exceeded two-thirds (71.7%), while Sabah and Sarawak together held less than one-third (28.3%), enabling the Malay Peninsula to easily amend the Constitution without the consent of Sabah and Sarawak.

According to the report of the 5th meeting of the MA63 Special Committee on September 8, 2022, Prime Minister Dato' Sri Ismail Sabri Yaakob had reviewed and approved the restoration of the proportion of parliamentary seats to 35% as stipulated in the 1963 agreement.

Currently, out of 222 parliamentary seats, 166 seats or 75% are located in the Malay Peninsula, while the remaining 25% or 56 seats belong to Sarawak (31 seats) and Sabah (25 seats).

Based on the aforementioned decision to restore 35% of parliamentary seats to Sabah and Sarawak, while keeping the current number of seats in the Malay Peninsula at 166, Sabah and Sarawak must increase their seats from 56 to 88 (34.646%), an additional 32 seats, making the total number of federal parliamentary seats 254.

I believe Prime Minister Dato' Seri Anwar Ibrahim will keep his word and happily fulfil his dignified pledge made on the eve of the 2022 general elections to restore Sabah and Sarawak's representation to 35% of parliamentary seats.

C) I propose the establishment of MA63 Official-Civilian Committees by the government.

The constitutional amendments related to the MA63 are a monumental undertaking that cannot be adequately addressed solely by the existing government committees. 

I suggest that, in addition to the current MA63 Special Committee, the government establish separate "Sabah MA63 Official-Civilian Committee" and "Sarawak MA63 Official-Civilian Committee," comprising representatives from political parties, associations, NGOs, and professionals, to ensure a comprehensive approach and to truly restore all the original rights of Sabah and Sarawak. This would be in accord with the spirit of democracy of the Madani Government. 

D) I call on the Madani Government to reinforce local democracy by reinstating local council elections which were suspended in 1969.

E) I also call on the Madani Government to forthwith implement Borneonisation by replacing Malayan federal officials with Sabah and Sarawak officials as per MA63. This was prioritised task to be done from 1963 was never carried out because of the federal takeover of local administration. 
                                                        
In conclusion, until the Sabah and Sarawak people receive justice, reparations and compensation for 60 years of loss of rights, entitlements and wealth and healing of grievances in Malaysia, they will actively search for alternatives to the federation of Malaysia.

Tahniah kepada Parti Keadilan Rakyat atas ulang tahunnya yang ke-25

Salam,

  Sempena ulang tahun ke-25 penubuhan Parti Keadilan Rakyat, saya ingin mengucapkan tahniah kepada anda dan semua ahli parti!

  Saya telah menyokong matlamat reformasi anda sejak permulaan gerakan reformasi anda.   Saya aktif menyertai penubuhan PKR cabang Bintulu mesyuarat PKR Bintulu banyak kali diadakan di rumah saya.

  Saya, Yu Qinglu dari Sibu, Sarawak, telah menyaksikan sejarah pembentukan Malaysia dari perspektif seorang lelaki berumur 77 tahun. Saya ingin mengemukakan beberapa cadangan untuk pertimbangan anda:

  A) Kerajaan persekutuan perlu menghargai Perjanjian Malaysia 1963

MA63, sebagai perjanjian antarabangsa, dianggap sebagai dokumen tertinggi yang mencipta Malaysia dan memastikan bahawa rakyat Sabah dan Sarawak tidak akan terus dirugikan atau menjadi mangsa akibat kehilangan hak MA63.

  Sejak 10 tahun lalu, keberkesanan MA63 telah dipersoalkan dan dicabar, dan ada yang mempersoalkan sama ada rakyat Borneo mendapat manfaat daripada persekutuan itu.

  Sama seperti perkahwinan antara kanak-kanak di bawah umur adalah tidak sah mengikut kontrak sivil, perjanjian antara wilayah kolonial yang belum mencapai kemerdekaan dan kedaulatan dan negara-negara merdeka yang berdaulat pada dasarnya adalah haram dan tidak sah.  Ini adalah prinsip membuat perjanjian undang-undang antarabangsa, yang menetapkan bahawa tanah jajahan adalah negara yang tidak mempunyai kapasiti undang-undang untuk membuat perjanjian antarabangsa.  Mahkamah Keadilan Antarabangsa mengesahkan ini dalam kes Kepulauan Chagos 2019.

  Oleh itu, MA63 adalah perjanjian yang sangat rapuh dan sebagai negara penerima MA63, terutamanya Malaya sebagai penaja bersama MA63 dengan UK, perhatian khusus mesti diambil untuk memastikan bahawa rakyat Sabah dan Sarawak tidak dirugikan dan mendapat manfaat mereka. .

  Menurut Tunku Abdul Rahman, perdana menteri pertama Malaysia, salah satu objektif utama penyerahan Sabah dan Sarawak kepada Persekutuan Malaysia yang dicadangkan adalah untuk membangunkan dua bekas jajahan British itu.

  Walau bagaimanapun, dalam tempoh setengah abad yang lalu, terdapat terlalu banyak contoh kerajaan terdahulu yang mengabaikan atau malah melucutkan hak Sabah dan Sarawak daripada kenyataan Perdana Menteri Tunku Abdul Rahman pada 18 Julai 1963 membuktikan perkara ini: Jika pada masa akan datang Menemui bahawa penubuhan. Malaysia "tidak akan memberi manfaat kepada kedua-dua wilayah itu, mereka boleh pergi begitu sahaja".   Terdapat banyak contoh "tiada faedah", yang dikesali dan menyedihkan.  Inilah sebabnya mengapa timbul sentimen di kalangan penduduk Borneo bahawa mereka tidak lagi mahu Sabah dan Sarawak kekal di Malaysia.

  Oleh itu, rakyat Sarawak digalakkan mendengar kata-kata anda menjelang pilihan raya umum 2022: "Jika saya dipilih dan menjadi Perdana Menteri, tidak akan banyak rundingan dan hak asal kedua-dua Sabah dan Sarawak akan dihormati dan kembali."

Sehingga kini, kami masih menaruh harapan yang tinggi agar keadaan akan berubah.  Kerajaan persekutuan dan Borneo mengakui pelanggaran berulang peraturan MA63 selama 60 tahun dan memulakan rundingan pada 2015 untuk membetulkan pelanggaran tersebut.

  Saya faham bahawa untuk memulihkan sepenuhnya hak MA63, pindaan tidak mengikut perlembagaan seperti Akta 354 (yang menghapuskan semua hak MA63), Akta Pelantar Benua 1966, Akta Laut Wilayah 2012, Akta Pembangunan Petronas 1974 (yang menjejaskan hak kita) mesti dimansuhkan. ).  Jika ini tidak dilakukan, MA63 masih dilanggar, mengakibatkan kesahihannya ditamatkan dan tidak mengikat para penandatangan.

  B) Peruntukan kerusi parlimen amat tidak menguntungkan Sabah dan Sarawak. 

Perwakilan Sabah dan Sarawak di Parlimen Persekutuan mesti dikembalikan kepada sekurang-kurangnya tahap 34.6% yang ditetapkan dalam MA63.  Ini adalah perlindungan yang termaktub dengan jelas dalam Perkara 161E dan 46 Perlembagaan Persekutuan dan tidak boleh diubah atau dipadamkan.

  Peruntukan kerusi ini bertujuan untuk menjaga hak ketiga-tiga ahli persekutuan baharu itu, membolehkan mereka memveto atau menyekat sebarang percubaan Malaya untuk meluluskan undang-undang yang menjejaskan hak mereka.  Kami ambil perhatian bahawa peruntukan kerusi ini adalah istilah asas/asas bagi Malaysia, yang ditunjukkan oleh Lord Lansdowne, Pengerusi IGC, semasa perbahasan Rang Undang-undang Malaysia di Parlimen British pada Julai 1963, kerana ia digunakan untuk memujuk pemimpin Borneo untuk menerima perjanjian dengan Tanah Melayu dan "faktor penentu" untuk persekutuan Singapura.

Selepas Singapura menarik diri dan merdeka pada tahun 1965, kerusi asal Singapura diberikan kepada parti Malaya. Apabila Perlembagaan dipinda oleh Akta 354 1976, Seksyen 161E telah dipadamkan. Jika peruntukan asas dipadamkan, perjanjian itu akan terjejas dan ditamatkan mengikut undang-undang antarabangsa, dan prinsip struktur asas yang disokong oleh undang-undang Malaysia. Akibatnya, MA63 tidak lagi mengikat penandatangan.
                                                        
Mengikut semangat perkongsian sama rata dalam MA63, adalah lebih baik Sabah, Sarawak dan Semenanjung Malaysia masing-masing mempunyai satu pertiga daripada kerusi parlimen diperuntukkan, kerana bilangan kerusi melambangkan kesaksamaan.

  Dalam pilihan raya persekutuan 1964, mengikut lampiran perjanjian MA63, Semenanjung Malaysia tidak boleh memegang lebih daripada dua pertiga daripada kerusi itu menduduki 104 daripada 159 kerusi (65.4%).

  Apabila kawasan pilihan raya diagihkan semula pada pilihan raya persekutuan 1974, perwakilan Semenanjung Malaysia di Dewan Rakyat melebihi dua pertiga (71.7%), manakala perwakilan Sabah dan Sarawak menurun kepada kurang daripada satu pertiga (28.3%) jika digabungkan dengan mudah perlembagaan tanpa persetujuan Sabah dan Sarawak.

  Menurut laporan mesyuarat ke-5 Jawatankuasa Khas MA63 pada 8 September 2022, Perdana Menteri Datuk Seri Ismail Sabri Yaakob telah menyemak dan meluluskan pemulihan bahagian kerusi parlimen yang ditetapkan dalam Perjanjian 1963 kepada 35%.

  Pada masa ini, antara 222 kerusi parlimen, sebanyak 166 kerusi atau 75% terletak di Semenanjung Malaysia, dan baki 25% atau 56 kerusi adalah milik Sarawak (31 kerusi) dan Sabah (25 kerusi).

Mengikut keputusan yang dinyatakan di atas untuk memulihkan 35% kerusi parlimen Sabah dan Sarawak, sambil mengekalkan 166 kerusi semasa di Semenanjung Malaysia, Sabah dan Sarawak mesti menambah kerusi mereka daripada 56 kerusi sebanyak 32 kerusi kepada 88 kerusi (34.646%), jadi bahawa kerajaan persekutuan Jumlah kerusi parlimen mencecah 254.

Saya percaya bahawa Perdana Menteri Datuk Seri Anwar Ibrahim akan mengotakan janjinya dan dengan sukacitanya menunaikan janji sungguh-sungguh yang dibuatnya pada malam pilihan raya umum 2022 untuk memulihkan 35% kerusi parlimen di Sabah dan Sarawak.

  C) Saya mencadangkan kerajaan menubuhkan jawatankuasa awam-swasta MA63.

  Pindaan perlembagaan yang dikaitkan dengan MA63 adalah tugas berat yang tidak boleh ditangani secukupnya oleh jawatankuasa kerajaan sedia ada sahaja.

  Saya mencadangkan bahawa sebagai tambahan kepada Jawatankuasa Khas MA63 sekarang, kerajaan perlu menubuhkan satu lagi "Jawatankuasa Rakyat Awam MA63 Sabah" dan "Jawatankuasa Rakyat Awam MA63 Sarawak", yang dianggotai oleh wakil parti politik, persatuan, pertubuhan bukan kerajaan dan profesional. untuk memastikan pendekatan menyeluruh diambil untuk benar-benar mengembalikan Semua hak asal kepada Sabah dan Sarawak.  Ini selaras dengan semangat demokrasi kerajaan Madani.

  D) Saya menyeru kerajaan Madani untuk mengukuhkan demokrasi tempatan dengan menyambung semula pilihan raya majlis tempatan yang digantung pada tahun 1969.                                    
  E) Saya juga menyeru kerajaan Madani agar segera melaksanakan Borneoisasi dengan menggantikan pegawai Malaya persekutuan dengan pegawai Sabah dan Sarawak di bawah MA63.  Keutamaan ini sejak 1963 tidak pernah dilaksanakan kerana kerajaan persekutuan mengambil alih kerajaan tempatan.

  Ringkasnya, sehingga rakyat Sabah dan Sarawak mendapat ganti rugi, pampasan dan pampasan atas kehilangan hak, kuasa dan kekayaan serta rungutan yang mereka alami di Malaysia sejak 60 tahun lalu, mereka akan secara aktif mencari alternatif kepada persekutuan.

Daniel John raised issue of tainted Sabah electoral roll at Bersih Congress in KL

             Daniel John Jambun raised the issue of "Projek IC" voters in Sabah at the Bersih Congress at KLSCAH in Kuala Lumpur today.

KUALA LUMPUR : A senior Sabah activist has raised again the issues of tainted electoral roll for Sabah at the Bersih Congress here today, calling on the NGO to help pressure the authorities to rectify things.

Daniel John Jambun, president of Borneo's Plight in Malaysia Foundation (BoPiMaFo), told delegates that the Projek IC was exposed during the RCI hearing in 2013 but nothing much has since been done.

"The tainted electoral roll issue in Sabah was filed in the high court of Kota Kinabalu two years ago by four Sabah assemblymen.

"The court ruled that the Election Commission (EC) can rectify the tainted electoral roll through administrative procedure, but we have yet to hear what have been done by authorities," he pointed out.

He raised this after the Bersih Executive Director, Ooi Kok Hin, presented his paper titled "Electoral Reform - Quoting Anwar Ibrahim's fierce movement to reform Malaysian election system" at the day-long congress held at the Kuala Lumpur and Selangor Chinese Assembly Hall here today.

Daniel said holders of 'Projek IC' in Sabah have been registered in the electoral rolls and allowed to vote in elections.

"I urge Bersih to assist the genuine Sabahans to pressure the Election Commission to clean the electoral roll," he said.
          With EC deputy chairman Azmi Sharom.

Speaking to Borneo Herald, Daniel said he had also met deputy chairman of EC, Azmi Sharom, and invited him to meet NGOs from Sabah who would like to meet him on the issue.

"Azmi told me he would gladly do so and he has no problem coming to Kota Kinabalu and meet NGOs and concerned individuals," Daniel said.#


June 18, 2024 decision whether SLS can continue to pursue Sabahan's right to 40% revenues

KOTA KINABALU : In an about turn, the GRS state government in Sabah, retracted all the "sensitive" arguments by Tengku Fuad Tengku Ahmad, earlier its appointed lawyer in the on-going court case of Sabah's claim to 40% of the revenue collected by the Federal government from the state.

The state attorney general, Datuk Nor Asiah Mohd Yusof, who appeared, via zoom meeting, at the Court of Appeal case management here today, presented a new three-point stand of the state government on the matter.

In fact the state government's new stand was in a written letter dated 23 May, 2024 to the appelate court by Nor Asiah, and was affirmed at the court today.

First, that the state government now did not want to challenge the leave granted by the High Court earlier in November 11, 2022 to Sabah Law Society (SLS) to proceed with the substantive hearing of its judicial review application in respect of the 40% Special Grant Entitlement of the State of Sabah.

Second, that the GRS government now retracts all submissions made by its lawyer Tengku Fuad in the Court of Appeal recently on May 16 2024, on the issue of locus standi of the SLS in pursuing the tax right claim.

Third, the state government also retracted Tengku Fuad's submissions in the same court on the Article 112C and 112D of the Federal Constitution as being  "an aspiration" and not a mandatory or absolute right of the State of Sabah.

Nor Asiah also informed the Court of Appeal today that Tengku Fuad has ceased to act for the Sabah state government, and that the State Attorney has taken over.

Both Tengku Fuad and Nor Asiah along with the Chief Minister, Datuk Hajiji Mohd Noor, had become targets of severe criticisms and foul comments in social media until today for the "sensitive" assertions by Tengku Fuad in the Court of Appeal last week, something unseen for a long time in Sabah.

In fact the night of the appelate court hearing last week, three of Hajiji's colleagues in GRS namely Datuk Dr Jeffrey Kitingan, Datuk Yong Teck Lee and Tan Sri Pandikar Amin went to Sri Gaya (CM official residence) and registered a very strong views to Hajiji on Tengku Fuad's line of arguments and advised (rather demanded) Hajiji to do something right to avoid further public backlash.

The trio, and the president of Parti Kerjasama Anak Negeri, Datuk Henrynus Amin, and former president of Upko, Datuk Madius Tangau, were among senior politicians seen mingling with a large crowd at the court compound last week. A few hundred Sabahans, activists, NGO leaders, politicians, young and old of various races, some in traditional gears, thronged the court compound in support of the SLS effort.

They brought along banners, some with words expressively supporting the 40% claim by Sabah.

This case has become a hot topic as it involves what Sabah claims to be its constitutional right, but which the federal government has successively failed or reluctant to adhere, affecting badly the ability of the state government to raise fund to develop the large state which is more than half of the whole size of the 11-state Peninsular or Malaya as is more commonly known in Sabah.

What irked Sabahans more is the reluctance of Hajiji to pursue the case, instead he agreed in 2022, without getting the consensus of the state legislative assembly, to a Federal proposal of special yearly grant of RM200-300 million for a period of five years, in lieu of the 40% claim which some claimed, if realised, could get Sabah fund in the region of RM4-5 billion annually.

The fact that Upko President Datuk Ewon Benedik and 11 other PH leaders, decided to retract similar suit much earlier, even though they promised would never do it, has further enraged Sabahans, accusing them of turn-coats and sold-souls, soon after they were given lucrative posts by the Federal Government.

Today, at case management, the Court's Deputy Registrar, Puan Norhamizah, informed that a decision by the three-member Court of Appeal, will be given on 18 June, 2024. 

At the case management today, the Federal Attorney-General was represented by Krishna Priya Veenagopal, while SLS was represented by David Fung, Jeyan Marimuttu and Janice Junie Lim. 

Nor Asiah appeared for the Sabah state government together with Datuk Brenndon Keith Soh, and Devina Teo.

The eagerly anticipated decision on June 18, will determine whether SLS can continue to pursue Sabahans' right to the 40% Entitlement for the lost years (1974 to 2021). 

From the law's perspective, it will indicate Malaysian courts' commitment to the path of justice for the public through Public Interest Litigation.

SLS, meanwhile, welcomes this latest development and is supportive of this latest position which is in line with the recent statement by the Chief Minister.#
