Water dams, flood mitigation could be scams to fill pockets of cronies, says activist

ANYONE who examines the proposed water dam and flood mitigation projects in Sabah will find that these may be scams designed for filling the pockets of some people. This reminds us of two gas projects in Sabah where money was taken by two companies from China and no work was done.

During Najib's time, according to media reports, RM400m was released for flood mitigation in Penampang, in the outskirts of Kota Kinabalu.

According to the locals, no work was done in the district but money was allegedly paid out. Flood mitigation includes work on improving drainage and new outlets and dredging and clearing the river.

When the floods returned the next year, worse than ever, those who allegedly took the RM400m claimed that actually RM2b was needed for flood mitigation in Penampang alone. No gov't in the world can afford paying out such huge allocations for work which isn't done.

The Babagon water dam, a white elephant, is one of the reasons for flash floods in Penampang.

When the dam is full during the heavier than usual rains, the water is released into the river which quickly overflows and causes flash floods. In Kerala for example, during heavy rains recently, 40 dams on 40 rivers caused the great floods. Kerala is a wet state.

Contrary to public perceptions, water dams don't supply water to water treatment plants. The plants take water directly from the river through inlet pipes.

During the dry season, the water dam would release water directly into the low lying river, just above the inlet pipes.

In Sabah, there are no dry seasons. The rivers are always full. So, water dams are redundant, especially since they don't produce even a small amount of electricity for the local area.

The current water shortage in Sabah may have been artificially manufactured by those pushing for the proposed multibillion ringgit water dam in either Kaiduan or Papar. 

Those who have been following the Sabah Water Dept case in court should know what's happening with gov't money.

According to the contractor in court, the entire dept was on the take. A certain percentage of the contract sum was distributed to Water Dept staff, from top to bottom, according to a formula. Pairin was mentioned in court as one of those on the take for many years. The judge pretended not to hear.

A witness in court, also on the take, has been appointed as the new Director of the Water Dept.

Having said that, water shortages can only happen if the water treatment plants are insufficient, or the piping was too old and bursts and leaks all the time, or the river water has been chemically contaminated.

River water, if chemically contaminated, kills the fish kept in acquariums at the water treatment plant/s. The water cannot be treated. It's released into the river and flows to the sea.

In the Bangsar area in KL for example, the frequent water shortages are due to the pipes leaking and bursting all over the place. If one area is fixed, another area will experience leaks. Insiders say no money is spent on new piping.

The water treatment plants don't pump out kopi susu water. If the water is kopi susu, it means that the piping has burst or is leaking, drawing in mud, dirt and bacteria or the water tank at the rooftop has not been cleaned for years or the huge water tanks in residential areas need good scrubbing.

Water also becomes kopi susu when turned on after interruption in supplies for even a few hours. The pressure is low because of air blockage. The red pipe below the wash basin, if opened, releases the air block and the water will rush out. Call the plumber to avoid injuries.

Indeed, conning the federal treasury has become the biggest business in Malaysia. 

Just read what Judge Sultan Abu Backer wrote about bogus contracts. He was suspended and retired. His allegations were never investigated. His Affidavit in Support was removed from a Ruling and court records.

The solar power project, purportedly in S'wak for rural schools, does not exist based on a media statement by the S'wak gov't. Yet the case was heard by the High Court.

In law, the court first looks at whether a contract exists. If there's no contract, the court will throw out the case.

If the contract is fraudulent, the court will also throw out the case.

The IGP and AG would have to address the fraud separately. It isn't about bribery and corruption but cheating the gov't or among the parties in dispute.

Untung tempat PM lawat dapat dana !!

NAMPAKNYA tempat-tempat yang sempat dilawati Perdana Menteri, Menteri dan Ketua Menteri pasti untung, tidak banyak, sedikit mesti ada.

Seperti lawatan Perdana Menteri Datuk Anwar Ibrahim ke perayaan Tadau Kaamatan Sabah di KDCA di Penampang dan juga kemudian di kampus Universiti Malaysia Sabah (UMS).

Di KDCA, Anwar umum "beri" RM1 juta, "walaupun Pairin tidak minta" katanya untuk penganjuran Tadau Kaamatan Sabah pada tahun depan (2024).

Ketika berdialog dengan siswa UMS pula, Anwar umum lulus "serta-merta" RM3 juta untuk mengatasi masalah tiada bekalan air dalam kampus UMS di Likas sejak Oktober tahun lalu.

Perkara yang sama juga berlaku ketika dia bertemu anggota tentera di Kem Lok Kawi Petagas, telah mengumumkan kelulusan imbuhan tetap atau Insentif Khas kepada lebih 30,000 tentera membabit peruntukan tahunan lebih RM80 juta.

Demikian juga apabila Ketua Menteri melawat kawasan tertentu maka ada sja "kelulusan" kilat projek-projek di situ. Tidak banyak, sedikit mesti ada.

Saya boleh bayangkan keberuntungan daerah-daerah atau kawasan yang sering dikunjungi PM dan Menteri-Menteri Persekutuan khususnya di negeri-negeri di Semenanjung yang memang sentiasa didatangi menteri silih berganti sejak 60 tahun ini.

Untunglah 11 negeri di Semenanjung yang menjadi tumpuan tapak kaki para menteri Pusat.

Jika begini, adalah lebih baik memastikan lebih kerap PM, Menteri turun bertandang ke Sabah dan Sarawak sebab dua negeri ini masih sangat teruk ketinggalan jauh dari segi infrastruktur jalanraya, air, elektrik, perumahan, kesihatan dan pendidikan.

Saya rasa jika kenderaan Anwar selalu menggunakan jalanraya misalnya dari Sepanggar/Tuaran ke ibu negeri, nescaya jalan-jalan tersebut akan lebih cepat dibaiki atau disiapkan.

Tu lebuhraya Pan-Borneo yang melintasi ibu negeri ke Tuaran dan seterusnya ke Kudat sudah lebih lapan tahun berubah-ubah arah, siang lain, malam pindah sudah, berlubang-lubang, senget-sengetan, bergelapan menyebabkan sudah sangat banyak kereta rosak, rim pecah, tayar pecah dan eksiden.

Sama juga jika Pegawai Daerah atau Jurutera Daerah tiap hari melalui jalan tertentu maka dia sendiri merasa apa yang perlu dibuat, sudah tentu masalah lebih cepat diatasi.

Namun, di Sabah tidaklah selalu begitu. Jalan yang dilalui setiap hari oleh Ketua Menteri atau Menteri-Menteri dan Pembantu Menteri belum tentu ada jaminan akan cepat diperbaiki.

Ada sesuatu yang tidak kena di sini.

Apapun lebih banyak/kerap PM, KM dan menteri-menteri serta MP dan Adun turun padang, lebih besar peluang masalah-masalah akan mendapat perhatian untuk diselesaikan.

Sabah Government confused on Article 6(7) and deleted it from Constitution

SABAH's gov't legal advisor Fuad Ahmad statement on Article 6(7) which has been deleted from the Sabah Constitution by the Hajiji government merits right of  reply.

The Hansard from before 1990 and media reports from and/or around that time will show that Article 6(7) covers the possibility that three or more political parties may be in the fray. It was about political stability.

Article 6(7) would be redundant if there are only two parties taking part in the state election.

Article 6(7) isn't about simple majority, and read with Article 6(3), does not rule out minority gov't. Coalition gov't can come after minority gov't has been sworn in.

Sabah, without Article 6(7), may be plagued again by endless power grab.

Even when Article 6(7) was in the Constitution, it was observed in the breach and/or there was no compliance.

After Joseph Pairin Kitingan in 1994, and before Shafie Apdal in 2018, and after the latter, all Chief Ministers were appointed in defiance of Article 6(7).

In fact, after two defections from gov't in 1994, Pairin was still the only lawmaker eligible for the Chief Minister's post.

He was literally chased out by dictatorial Prime Minister Mahathir Mohamad. Shafie Apdal's maternal uncle Sakaran Dandai, was picked by Mahathir as Chief Minister. That's violation of the Sabah Constitution.

Sakaran stepped down after nine months and became Governor. He has since passed away.

After Sakaran and before Musa Aman, there was a Chief Minister every two years. Musa's appointment, also unconstitutional, saw the end of the rotation of the Chief Minister's post every two years.

The Pandora's Box opened after the Governor appointed Shafie Apdal as Chief Minister on Sat 12 May 2018, two days after appointing Musa Aman unlawfully. Shafie Apdal was the rightful Chief Minister under Article 6(7).

Musa Aman took the matter to court. He was denied by the High Court and the court of appeal. The High Court did not tell Musa that he wasn't eligible under Article 6(7). Instead, it pontificated sanctimoniously on this and that and that and this.

The court of appeal saw no reason to set aside and or disturb the High Court Ruling based on the "dictionary meaning of majority".

The Federal Court, by majority opinion on Tues 1 Sept 2020, said the Governor had no discretion beyond that defined in the Sabah Constitution. In short, the Governor could not sack Musa i.e. if he did. The Governor denied sacking Musa and claimed that he only advised him to step down. The Federal Court should have told Musa that he was never appointed under Article 6(7).

Again, bad habits die hard, as Hajiji was appointed Chief Minister after the snap Sabah election on Sat 26 Sept 2020. Shafie was the only eligible candidate under Article 6(7).

Since Article 6(7) has been deleted, the state assembly remains the right and proper forum for electing the Chief Minister. There should be at least three candidates, from across the political divide, in the running. The Speaker has discretion. If no candidate gets 51 per cent of the votes counted, there should be runoff between the top two contenders.

Based on parliamentary procedures in the Commonwealth, at least two-third of the
state assembly should be present and voting for the new Chief Minister. That provides the quorum.

Voting should be by show of hands. There should be no secret ballot or voice vote.

The new Chief Minister can form Cabinet of lawmakers, not political parties.

PBM Sabah lebih aktif selepas mendapat Pengerusi baru

Kota Marudu : Parti Bangsa Malaysia (PBM) cawangan Sabah dijangka melaksanakan lebih banyak aktiviti dalam bulan-bulan akan datang ini.

Ketuanya, Jupperi Lenson, memberitahu Borneo Herald, beliau menjangka lebih banyak program PBM Sabah dibuat dengan kerjasama PBM Pusat.

"Kita akan umumkan program-program berkenaan selepas kunjungan hormat pimpinan negeri beserta Presiden PBM, Datuk Larry Sng kepada Ketua Menteri, Datuk Hajiji Noor," katanya.

Tarikh kunjungan hormat itu bagaimanapun belum dimuktamadkan.

Demikian juga dengan sambutan Tadau Kaamatan PBM di Kota Marudu belum diumumkan.

Sementara itu, dalam diam-diam, Jupperi dan pimpinan PBM Sabah aktif merekrut ahli baru dan mengambil bahagian dalam majlis politik di seluruh negara termasuk Konvensyen Nasional Kerajaan Perpaduan di Kuala Lumpur 14 Mei baru-baru ini.

PBM Sabah kini ada kira-kira 25,000 orang ahli dengan 14,000 darinya adalah di Bahagian Kota Marudu yang diketuai sendiri oleh Jupperi.

Pemilihan Mr Kaamatan itu julung kali diadakan di Dewan KDCA Penampang semalam dihadiri ramai peminat yang memenuhi dewan. Tiket masuk RM15 dikatakan laris.
MRK kini menjadi salah satu tarikan utama pada perayaan dua hari di Dewan KDCA, mendampingi pemilihan Unduk Ngadau atau Ratu Pesta Kaamatan pada kemuncak sambutan esok, 31 Mei, 2023.#


What was the Article 6(7) of Sabah Constitution recently repealed by the GRS-controlled DUN


MUCH have been said about the recent amendment or rather repeal of Article 6(7) of the Sabah Contitution. But what it is actually? The said article was initiated and passed during the PBS government and meant to guide the state TYT in the appointment of a Chief Minister immediately after a state general election.
Here is one view on the said repeal pushed by  the current GRS government and passed, as GRS commands two third majority in the State Assembly. Opposition Warisan however voted against the repeal..    Editor
